Acceptance of Agreement You acknowledge that payment of the deposit or full balance via our secure payment link acts as your electronic signature and binding agreement to these Terms. If your payment was processed prior to the date of this update, the Terms and Conditions valid at the time of that payment govern your event.

These Terms & Conditions (“Agreement”) govern all restroom trailer rentals and services provided by Elevate Restroom Suites LLC (“Elevate,” “we,” “us”). By submitting any payment, confirming your order, or taking delivery of the trailer, you (“Client”) agree to all terms below.

This is a living online agreement. The newest version posted at:

automatically applies to all current and future rentals, even if updated after booking.

1. Booking, Payment & Reservation Policies

1.1 Reservation Confirmation
Your rental is confirmed once Elevate receives your deposit or any form of payment.
Payment = legal acceptance of all Terms & Conditions.

1.2 Deposit
A 50% non-refundable deposit is required to secure your date.

1.3 Final Payment
Final payment is due 3 days before delivery unless otherwise written.

1.4 Cancellations

  • More than 14 days before event: Deposit retained; no additional charges.

  • 14 days or less: Full invoice total is due; no refunds.

  • Weather-related cancellations are not refundable. Trailers operate in all weather if access is safe.

2. Power Requirements

Client is responsible for safe, reliable power for the entire rental period.

2.1 Required Power Supply
Client must provide:

  • One (1) dedicated 120V / 20A circuit

  • Within 100 ft of trailer placement

  • Not shared with DJs, catering, heaters, lighting, or other equipment

Electrical failures from client-provided power are not Elevate’s responsibility.

2.2 Generator Option
If adequate on-site power is unavailable, a generator package will be added to the rental at a rate of $150 per event day.

3. Water Supply Requirements

Client must provide one of the following:

3.1 Onsite Spigot

  • Clean water source

  • Standard ¾” hose spigot

  • Within 100 ft of trailer

  • 30–60 PSI recommended

3.2 Onboard Fresh Water

  • Water Supply & Access The Client is responsible for providing access to a standard freshwater spigot at the event location. If a direct water connection is unavailable, Elevate will provide an onboard freshwater supply to ensure service continuity. Please note that usage of the onboard water supply will incur an additional Water Service Fee of $100.00 per event, which will be added to the final invoice.

4. Winter Requirements (October–April)

Client is responsible for ensuring:

  • Power remains connected for heating

  • Doors remain closed

  • Spigots are freeze-proof

  • Lines and hoses are protected

  • Placement area is accessible and free of snow/ice

Failure to comply may result in freeze damage, billed at full repair cost.

5. Site Access, Placement & Delivery Conditions

5.1 Space Requirements
Client must provide:

  • Level pad (20–30 ft long × 10 ft wide)

  • 12 ft vertical clearance

  • 60 ft turning radius for truck + trailer

  • No overhead branches, snow piles, soft ground, mud, or obstructions

5.2 Failed Delivery Attempts
If Elevate arrives and cannot deliver due to blocked access, soft ground, or safety issues, full payment remains owed. Client will work to identify an alternative viable spot or improve access so delivery can be completed.

5.3 Do Not Move the Trailer
Client and guests may not move or tow the trailer under any circumstances.

6. Servicing, Multi-Day Rentals & Emergency Calls

6.1 Standard Rentals
All trailers come sanitized, stocked, and event-ready.

6.2 Multi-Day Rentals
Multi-day events require servicing that may include:

  • Pumping

  • Restocking

  • Freeze checks (seasonal)

  • System inspections

6.3 Emergency Callouts
One courtesy call is included.
Additional calls: $85 per hour + mileage.

7. Damage, Liability & Extraordinary Cleanup

7.1 Client Responsibility for Damage

Client is responsible for any damage not caused by Elevate, including:

  • Broken or damaged interior fixtures

  • Frozen pipes caused by Client not meeting winter requirements

  • Electrical damage caused by Client power issues

  • Damage caused by guests, vendors, or attendees

  • Tire/rim damage if Client instructs unsafe placement

7.2 Extraordinary Cleanup Fees

Severe sanitation events may incur $200 cleanup fee, including:

  • Vomit (inside or outside the trailer)

  • Feces on floors, walls, or any surfaces

  • Urine on surfaces or floors

  • Diaper explosions

  • Blood or bodily fluids

  • Excessive mud, paint, food, alcohol, glitter, or trash

  • Vandalism

Elevate photographs each trailer at delivery and pickup for documentation.

8. Prohibited Waste

Do NOT dispose of:

  • Feminine hygiene products

  • Diapers

  • Wipes (including “flushable”)

  • Paper towels

  • Chemicals, oils, grease

  • Trash or foreign objects

Client agrees to cover all repair/replacement costs resulting from misuse.

9. Weather, Access & Force Majeure

Elevate is not liable for delays or service interruptions caused by:

  • Severe weather

  • Mud or snow preventing access

  • Venue restrictions or HOA policies

  • Power outages

  • Flooding, fire, natural disasters

  • Government shutdowns or road closures

If pickup is delayed due to conditions, additional trips will be billed.

10. Permits, Venue Rules & Regulations

Client is fully responsible for:

  • Venue approval

  • HOA policies

  • City or county permits

  • Compliance with all local regulations

  • Placement permissions on private property

11. Equipment Substitution

If the reserved trailer becomes unavailable due to mechanical issues, Elevate may provide a substitute trailer of equal or higher quality at no additional cost.

12. Indemnification & Liability

Client agrees to indemnify and hold Elevate harmless from any claims, injuries, damages, or losses arising from:

  • Guest misuse

  • Negligence by Client or attendees

  • Improper utilities supplied by Client

  • Unsafe site conditions

  • Third-party interference

  • Poor placement conditions requested by Client

Elevate’s liability is limited to the total rental amount paid.

13. Photography, Media Use & Marketing Rights

Client agrees Elevate may photograph or film:

  • The trailer

  • Exterior placement

  • Setup, staging, and surrounding area

These images may be used for:

  • Website gallery

  • Social media

  • Online and print advertising

  • Brochures, listings, digital marketing

  • Educational and portfolio use

Elevate will never publish identifiable guests without permission.
Client may request removal of a specific image in writing.

14. Governing Law

This Agreement is governed by the laws of the State of Colorado.
Any legal actions must be filed in Denver County, Colorado.

15. Acceptance of Terms (Living Agreement Clause)

By submitting payment, clicking a payment link, filling out a quote form, replying with booking confirmation, or taking delivery, the Client agrees that:

  • They have read and agree to these Terms & Conditions.

  • Payment constitutes binding acceptance without a physical signature.

  • All future updates to this webpage automatically apply to their booking.

  • This online Agreement supersedes any prior verbal or written communication.

Construction & Long-Term Rental Terms (30+ Days)

The following terms apply to all construction, commercial, disaster response, government, and long-term rentals of thirty (30) days or longer. These terms supplement and supersede short-term event rental terms where applicable.

1. Rental Term & Billing

1.1 Rental Term
Long-term rentals are defined as any rental exceeding seven (7) consecutive days. The specific rental duration, billing structure, and servicing frequency shall be defined in the applicable written rental agreement, invoice, or proposal. Rental charges will continue until equipment is picked up or returned, regardless of anticipated project completion dates.

1.2 Billing Structure
Rental fees are billed monthly in advance unless otherwise stated in a written agreement.

1.3 Extensions & Holdover
If the unit remains on site beyond the agreed rental end date without written termination, rental charges will continue at the agreed monthly rate on a prorated daily basis until pickup is completed.

1.4 Early Termination
Client-initiated early termination does not relieve Client of payment obligations for the agreed minimum term. Prepaid rental fees are non-refundable unless otherwise agreed in writing.

2. Delivery, Setup & Pickup

2.1 Site Preparation
Client must provide:

  • Level, stable ground suitable for trailer placement

  • Clear access for delivery truck and service vehicle

  • Minimum 14 ft overhead clearance

  • Safe ingress and egress at all times

2.2 Access Requirement
Trailer must remain accessible for servicing and pickup. If access is denied or obstructed, additional service charges may apply.

2.3 Relocation Prohibited
Trailer may not be moved, repositioned, or relocated without prior written consent from Elevate Restroom Suites. Unauthorized relocation voids liability protections.

3. Utilities & Operational Requirements

3.1 Electrical Power/Client-Provided Power
Client must provide:

  • One (1) dedicated 120V / 20A circuit within 100 feet of trailer placement

  • Circuit must not be shared with DJs, catering equipment, heaters, lighting, tools, or other equipment

  • A 240V outlet may be required for winter operation or heater functionality

Electrical failures, breaker trips, insufficient amperage, voltage drops, or damage caused by client-provided power are not the responsibility of Elevate Restroom Suites.

3.2 Generator Use (If Required)
If adequate electrical service is not available within 100 feet of trailer placement, a generator will be required.

If a generator is provided by Elevate Restroom Suites:

  • Generator rental will be billed separately unless otherwise stated in writing

  • Generator will be delivered full of fuel

  • Client is responsible for refueling during the rental term unless otherwise negotiated in writing

  • Refueling charges will apply if the generator is not returned full

  • Fuel consumption varies based on usage, runtime hours, and electrical load demand

Elevate Restroom Suites is not responsible for service interruptions caused by fuel depletion, improper generator operation, overloading, or failure to refuel unless refueling service has been expressly agreed to in writing.

Temporary Electrical Service (Temp Meter Option)

If Client elects to provide temporary electrical service (temporary meter and/or distribution panel) in lieu of generator rental, Client is solely responsible for all costs, permitting, coordination with the utility provider, licensed electrician services, installation, maintenance, and removal of such service.

Temporary power must provide:

  • One (1) dedicated 120V / 20A circuit within 100 feet of trailer placement

  • Circuit must not be shared with other equipment

  • 240V service if required for winter or heater operation

Temporary power must be fully installed, energized, and operational at the time of trailer delivery. If temporary service is not available, insufficient, or experiences interruption, Elevate Restroom Suites reserves the right to require generator rental at the applicable rate.

Elevate Restroom Suites is not responsible for delays, service interruptions, equipment damage, or operational issues caused by utility provider delays, insufficient amperage, voltage fluctuations, breaker trips, or site electrical deficiencies.

3.2 Water Supply
Client must provide:

  • A clean water source

  • Standard ¾” hose spigot

  • Located within 100 feet of trailer placement

If a direct water connection is not available within 100 feet, Elevate Restroom Suites may fill the onboard freshwater holding tank as part of delivery or scheduled service.

Additional freshwater refills beyond normal servicing may incur additional charges unless otherwise agreed to in writing.

Frozen water lines, insufficient water pressure, contaminated water supply, or plumbing failures related to site conditions are the responsibility of the Client.

Elevate Restroom Suites is not responsible for service interruptions resulting from lack of water access, frozen conditions, or site-related plumbing deficiencies.

4.Servicing & Waste Management

4.1 Scheduled Service
Servicing frequency (e.g., once or twice weekly) will be defined in the rental agreement.

4.2 Emergency Service Calls
Emergency service calls outside scheduled service are billed at $85 per hour plus mileage unless otherwise stated in writing.

4.3 Tank Capacity Responsibility
Client is responsible for ensuring usage does not exceed tank capacity between scheduled services. Excessive overfill resulting from misuse or over-capacity conditions may result in additional charges.

4.4 Service Access
Trailer must remain unlocked and accessible during scheduled service windows.

5. Site Conditions & Safety

5.1 Jobsite Compliance
Client is responsible for complying with OSHA, state, and local sanitation regulations.

5.2 Winter Conditions
Client is responsible for maintaining safe site conditions including snow removal, ice mitigation, and preventing freezing conditions that impair trailer operation.

5.3 Unsafe Conditions
Elevate Restroom Suites reserves the right to suspend servicing if site conditions are deemed unsafe.

6. Damage, Loss & Liability

6.1 Client Responsibility
Client is responsible for:

  • Damage beyond normal wear and tear

  • Vandalism

  • Theft

  • Misuse

  • Relocation damage

6.2 Insurance
Certificate of Insurance available upon request. Additional insured status available for an administrative fee.

6.3 Limitation of Liability
Company liability is limited to rental fees paid under the applicable rental agreement.

7. Payment Terms

7.1 Payment Due
Full payment for the initial term is due prior to delivery unless otherwise agreed in writing.

7.2 Overdue Accounts
Overdue balances are subject to a 1.5% monthly finance charge.

7.3 Non-Payment
Company reserves the right to remove equipment immediately for non-payment, denial of access, or breach of contract.

8. Permits & Compliance

Client is solely responsible for securing any required permits and ensuring compliance with all local, municipal, state, or federal regulations.

9. Indemnification

Client agrees to indemnify and hold Elevate Restroom Suites harmless from third-party claims arising from use of the equipment, except in cases of gross negligence or willful misconduct by the Company.

10. Governing Law

These terms are governed by the laws of the State of Colorado. Venue shall be in Denver County, Colorado.
